Parmi les grandes innovations : le renforcement des peines d’inéligibilité et d’accès aux fonctions publiques pour les personnes condamnées pour des faits de corruption. Le projet prévoit également la déclaration obligatoire du patrimoine pour tous les agents publics, des sanctions en cas de non-déclaration, l’encadrement du financement des partis politiques, l’interdiction de l’utilisation des biens de l’État à des fins électorales et la protection des lanceurs d’alerte. Sur le plan répressif : prescription portée à 30 ans, inversion de la charge de la preuve pour l’enrichissement illicite, amendes indexées sur le gain illicite ou le préjudice subi par l’État, ainsi que renforcement des sanctions. Le texte renforce enfin les mécanismes de gel, saisie, confiscation et recouvrement des avoirs issus de la corruption. Avec ce projet, l’ambition affichée est claire : faire en sorte que la corruption ne soit plus rentable et que nul ne puisse se soustraire à la justice en raison de son rang ou de sa fonction.
