    📌 La Liberación del Oro Venezolano como Exigencia Soberana y Humanitaria 🇻🇪 La concepción de la política institucional exige comprender que el Derecho Constitucional no es una entelequia teórica ni abstracta: es el instrumento más depurado para transformar realidades complejas en un orden social pacífico y funcional. Desde la prudencia política, ningún obstáculo procesal en Londres puede prevalecer sobre el acuerdo unánime de la comunidad política venezolana cuando el fin supremo es preservar la vida humana. I. Fundamentos Constitucionales e Internos 1. Prevalencia de la Sustancia Política sobre la Ficción de Representación: El realismo jurídico constitucional enseña que el Derecho es aquello que opera fácticamente en la realidad social. Las disputas en tribunales británicos (foreign act of state y one voice doctrine) han quedado desfasadas frente a un hecho jurídico irrefutable: el consenso en la mesa de diálogo entre el Gobierno Nacional y la AN 2015, sumado al reconocimiento del Gobierno de EE. UU. y la comunidad internacional al Gobierno de la Presidenta (E) Delcy Rodríguez. Cuando los actores internos pactan destinar un activo a la vida y la reconstrucción, el impedimento extranjero pierde su razón (ratio iuris). La voluntad unificada extingue la bicefalia y la incertidumbre procesal de las instituciones de Inglaterra. 2. Cláusula del Estado Social y Primacía del Valor Vida: Las reservas de la Nación no pueden permanecer inmovilizadas en una abstracción legal mientras el pueblo sufre los efectos de catástrofes naturales como los recientes terremotos. Hermenéuticamente, el valor Vida prevalece sobre la rigidez de la Forma Procedimental. 3. Inalienabilidad del Patrimonio de la Nación: Las 31 toneladas de oro en el Banco de Inglaterra no pertenecen a un gobierno ni a una facción: son propiedad imprescriptible e inalienable de la República Bolivariana de Venezuela. El dictamen consensuado garantiza que el activo sea protegido en su conversión y no desviado de la reconstrucción nacional. II. Derecho Internacional y Praxis Multilateral - Estado de Necesidad: Legitima la inaplicación de formalismos para evitar un mal mayor. Retener recursos destinados a salvar vidas vulnera directamente los Derechos Humanos del pueblo venezolano. - Arreglo Pacífico de Controversias: Impedir la ejecución de los recursos pactados en una negociación legítima contraviene los principios del DIP y de las Naciones Unidas. - Vinculación de Potencias Garantes: Si EE. UU. y otras potencias han respaldado el diálogo, desconocer sus frutos incurre en una contradicción jurídica. Lo pactado en lo político produce efectos vinculantes en lo judicial exterior. III. Pragmatismo Financiero y Arquitectura Operativa Para que la reconstrucción del país sea viable, el fin supremo debe guiar la ingeniería financiera: - Escudo Financiero: Transferir temporalmente la liquidez hacia el Departamento del Tesoro de EE. UU. (o un fideicomiso aliado) es la vía más expedita e inexpugnable para monetizar reservas congeladas. - Superación del Positivismo Inoperante: Un lingote inerte en una bóveda en Londres vale cero frente a la emergencia; un recurso canalizado que se convierte en hospitales, escuelas, infraestructura hídrica y vivienda, es solución real e inmediata para los venezolanos. Conclusión La fórmula del diálogo institucional para exigir el Oro Venezolano es jurídicamente inexpugnable, políticamente viable y humanitariamente impostergable e imperativa. El Realismo Jurídico Constitucional exige dejar de lado formalismos caducos y consignas retóricas: el oro es solo un instrumento al servicio del bienestar general. Utilizar las plataformas financieras internacionales como puente seguro representa una medida de fuerza mayor alineada con la soberanía y la dignidad de Venezuela. Un constitucionalista riguroso no se queda en el debate leguleyo o de opinadores de oficio, sino que aterriza el Derecho en la efectividad política y la urgencia humanitaria.📝🦉
