Müvekkilim Tayfun Kahraman hakkında verilen Anayasa Mahkemesi kararına İstanbul 13. Ağır Ceza Mahkemesi’nin uymaması nedeniyle, İstanbul 14. Ağır Ceza Mahkemesi’ne bugün itibariyle itirazımızı yaptık. İtirazımızda temel olarak dayandığımız hususları kamuoyunun bilgisine de sunmak isteriz: 📌 İlk hükmü veren hakimlerin CMK 23/3 maddesi gereğince yeniden yargılamaya katılamayacağı yeniden yargılama kararı verilmesine iştirak dahi edemeyeceği (YCGK) gerekçesiyle karar veren hakimlerin yasaklı olmalarına rağmen karara katılmaları hukuka kesin aykırılık halidir ve kararın kaldırılmasını gerektirir. 📌 Anayasa Mahkemesi kararları kesin olarak verilir(AY m.153) Yasama, Yürütme, Yargı makamları, tüm gerçek ve tüzel kişileri bağlar. Dolayısıyla İstanbul 13. Ağır Ceza Mahkemesinin kararın uygulanması yönünden takdir hakkı yoktur. 📌 İstanbul 13. Ağır Ceza Mahkemesi daha önce benzer gerekçe ile verilmiş ve benzer mahiyetteki Anayasa Mahkemesinin hak ihlali kararlarına uymuş,(AYM BB: 2018/24786) yeniden yargılama yapmış ve sanıkların beraatine hükmetmiştir. Dolayısıyla benzer mahiyette ve aynı hakimlerin iştirak ettiği heyetin müvekkil Tayfun Kahraman hakkında yeniden yargılama ret kararı vermesi hem mahkemenin kendi uygulamasına hem de kanun önünde eşitlik ve hukuki öngörülebilirlik ilkelerine aykırıdır.

Sulh Ceza Hakimliği 16 genci tutukladı. 1 genç bu suçlamadan serbest bırakıldı. "2911 ve Cumhurbaşkanına hakaret" suçlamasından 17 genç serbest bırakıldı. Dün gözaltına alınan bir gece Vatan Emniyet'te tutulan 17 TİP'li Öğrenci (@tipliogrenci) "2911, mukavemet, mala zarar verme ve Cumhurbaşkanına hakaret"le suçlandı.
