¿Operación tortuga en la JEP para justificar la ampliación de su periodo y contratar más burocracia? Contrario a lo manifestado por la JEP, la Procuraduría desde el año pasado alertó en varias ocasiones que el Tribunal no estaría cumpliendo los términos para adelantar las investigaciones, lo cual no permitiría surtir con garantías la fase adversarial (juicios) contra los comparecientes que no aceptaron responsabilidad (Fuerza Pública) La cuenta es muy sencilla. La JEP tiene 10 años desde su entrada en operación para presentar las acusaciones contra los comparecientes que no aceptan responsabilidad. Esto implica que primero la Sala de Reconocimiento de Verdad debe hacer su investigación y pasar los expedientes a la Unidad de Investigación -UIA- para que formule la acusación. Para cumplir los tiempos, todos los expedientes de los macrocasos debieron enviarse a más tardar el 15 de septiembre de 2025 para que la UIA pueda investigar con los términos de la Ley (30 meses), pero la propia JEP afirmó que terminaría de remitir los casos entre 2027 y 2028. Si el tiempo de investigación se extiende, los militares que no aceptaron responsabilidad tendrían que someterse a un juicio express, contra reloj, que terminará de violar todas sus garantías. La única alternativa, y seguramente a lo que están jugando los magistrados, sería ampliar el periodo de la JEP, con lo cual seguirían atornillados a los puestos que tienen de forma vitalicia.
