زبان آلمانی، زبان فلسفه است و طبیعی است که این ویژگی روی همهچیزش اثر بگذارد؛ از صنعت و اقتصاد گرفته تا حقوق و فلسفهٔ حقوق. امروز یک کلمهٔ آلمانی این موضوع را برایم یادآوری کرد و بعدش یک فکر عمیقتر به ذهنم رسید: ما در فارسی میگوییم «زندانی کردن» یا «به زندان انداختن»؛ در انگلیسی و فرانسه و عربی و… هم تقریباً همین مضمون را داریم. یعنی تأکید روی «زندان» است. اما آلمانی میگوید Freiheitsstrafe؛ یعنی؛ مجازاتِ سلب آزادی. به نظرم این فقط یک تفاوت زبانی نیست. در «زندانی کردن» میگوییم با او چه کردیم؛ اما در «سلب آزادی» میپرسیم چه چیزی را از انسان گرفتیم: آزادیاش را. اینجاست که پای جناب هگل هم وسط میآید. در فلسفهٔ حق هگل، مجازات فقط این نیست که «تو کار بدی کردی، پس تنبیهت میکنیم». مسئله میشود حق، اراده و آزادی. انسان موجودی آزاد و صاحب اراده است؛ پس جرم فقط یک «کار بد» نیست، بلکه نقض حق است. مجازات هم صرفاً انتقام یا رنجدادن نیست؛ در منطق هگلی، پاسخی به نفی حق است؛ نوعی نفیِ نفیِ حق و بازگرداندن اعتبار آن. حالا دوباره به Freiheitsstrafe نگاه کنیم. اگر مجازات «سلب آزادی» است، سؤال بلافاصله این است: کدام آزادی؟ تا کجا؟ و برای چه مدتی؟ این به نظرم نکتهٔ ظریفی است. «زندان» یک مکان است و در واقع فقط ابزار مجازات است. پس چرا باید خودِ مجازات را به نام ابزارش بشناسیم؟ این به نظر من درست نیست! حتی میتوان گفت این نوع نامگذاری، نه فقط از نظر فلسفه و حقوق، بلکه از منظر جامعهشناسی و روانشناسی هم کمی تا قسمتی عقبافتاده است. حالا فرض کنید در کشورهایی که هنوز مجازات اعدام پابرجاست، به جای «اعدام» بگویند: سلب حق حیات، چه اتفاقی میافتد؟ برای موافق اعدام، معنایش میتواند این باشد: اگر کسی حق حیات دیگری را سلب کرده، مجازاتش این است که همان حق از خودش هم سلب شود. برای مخالف اعدام، اما سؤال دیگری پیش میآید: آیا اصولا کسی حق دارد حیاتی را که خدا داده سلب کند؟ در چه شرایطی؟ میبینید؟ خودِ واژه ما را مجبور میکند دربارهٔ «حق» حرف بزنیم؛ در حالی که «اعدام» بیشتر فقط به ابزار اشاره میکند. درست مثل «زندان». تازه در کاربرد همین کلمهٔ «اعدام» بهعنوان ابزار، یک ابزار دیگر هم به آن اضافه میکنیم: «اعدام با چوبهٔ دار»! از این منظر، در مقابل «زندان» که یک ابزار و مکان است، آزادی یک حق است. وقتی میگوییم آزادی کسی را سلب کردهایم، معنای دقیقتری پیدا میکند: کسی که آزاد بوده و صاحب اراده بوده، اگر مرتکب جرمی شده، حالا به حکم قانون باید بخشی از آزادیاش محدود شود. اینجا دیگر نمیتوانیم بهسادگی بگوییم «او را انداختیم زندان». باید بپرسیم: چه مقدار از آزادی او را، چرا و تا کجا میتوانیم سلب کنیم؟ و آیا با این نگاه، کلمات «زندان» و «حبس» کمکم از مرکز مفهوم مجازات کنار نمیروند؟ شاید زندان اصلاً خودِ مجازات نباشد؛ فقط وسیلهای برای اجرای مجازاتی باشد که موضوع واقعی آن، محدود کردن آزادی است. شاید همین است که زبان حقوقی آلمانی را برای من جالب میکند: یک واژهٔ ظاهراً ساده، ناگهان ما را از زندان به آزادی، از تنبیه به حق، و از جرم به اراده میبرد. و این فلسفه چهها که نمیکند! شاید اگر همین نگاه فلسفی را جدیتر وارد مسائل حقوقی کنیم، به نتایج بهتری برسیم؛ نتایجی که نه فقط برای مجرم و قربانی، بلکه برای کل جامعه بهتر باشد و جامعه را به مکانی امنتر و کمرنجتر برای زندگی تبدیل کند. @emadeddinbaghi
