ผมไปร่วมงานรำลึกอาจารย์นิธิ เอียวศรีวงศ์ ในวงเสวนา "คิดต่อจากนิธิ" โดยนำเอาบทความชิ้นสำคัญของอาจารย์นิธิที่ชื่อ "ความชอบธรรมที่ล่มสลาย" มาพูดคุยกันครับ ในวงเสวนา ผมตั้งข้อสังเกตเพิ่มเติมจากมุมมองของอาจารย์นิธิว่า ในอดีตรัฐบาลไทยที่ล่มสลายไปหลายครั้งนั้น ไม่ได้เป็นเพราะ "ไม่มีความชอบธรรม" เสมอไป เพราะประเทศไทยเป็นประเทศที่ถูกปกครองโดยคณะรัฐประหารยาวนานที่สุด และการรัฐประหารแต่ละครั้งก็มักถูกรับรองโดยระบบยุติธรรมของรัฐเอง จนทำให้เส้นแบ่งระหว่างความชอบธรรมกับการดำรงอยู่ได้ของอำนาจนั้นพร่าเลือนไป ส่วนเรื่องเล่าที่ว่า "แม้แต่ระบอบรัฐประหารที่ไม่มีความชอบธรรมก็ยังต้องแสวงหาความชอบธรรมผ่านการสร้างเรื่องเล่า เช่น อ้างความจงรักภักดี หรืออ้างว่าเข้ามาปราบคอร์รัปชัน เพื่อค้ำยันอำนาจของตนเอง" ....ผมเห็นว่าเรื่องเล่าลักษณะนี้เริ่มทำงานไม่ได้ผลอีกต่อไปแล้ว และการทำรัฐประหารแล้วอ้างความจงรักภักดีอาจตอบโจทย์สังคมสมัยใหม่ได้น้อยลงเรื่อยๆ ทำให้เมื่อมาถึงจุดนี้ ผู้มีอำนาจแทบไม่จำเป็นต้องพึ่งพาเรื่องเล่าเพื่อความชอบธรรมแบบเดิมอีกต่อไปด้วยซ้ำ เพราะสิ่งที่พวกเขาสร้างขึ้นมาแทนคือระบบที่ไม่เป็นประชาธิปไตยอย่างยิ่ง เป็นเครือข่ายซับซ้อนเชื่อมโยงกันขององค์กรและบุคคลที่ไม่ได้ยึดโยงกับประชาชน แต่กลับมีอำนาจเด็ดขาดเหนือฝ่ายที่มาจากการเลือกตั้งทั้งฝ่ายนิติบัญญัติและฝ่ายบริหาร ระบบเช่นนี้จึงเข้มแข็งและมีภูมิต้านทานในตัวเองสูงมากต่อการเปลี่ยนแปลงใดๆ ...
