UMA DECISÃO IMPORTANTE DO SUPREMO TRIBUNAL FEDERAL MERECE ATENÇÃO. Por 6 votos a 4, o STF reconheceu, no caso de uma condenada pelos atos de 8 de janeiro, a possibilidade de considerar no abatimento da pena o período em que houve recolhimento domiciliar noturno e nos fins de semana. O ministro Alexandre de Moraes ficou vencido nesse ponto. Infelizmente, a decisão não anulou a condenação nem absolveu a ré. O que mudou foi o cálculo do período considerado para o cumprimento da pena. O entendimento chama atenção porque outros condenados submetidos a medidas semelhantes poderão apresentar pedidos à Justiça buscando o reconhecimento da detração, cabendo a análise jurídica em cada situação. O próprio STF já vinha discutindo, em tema de repercussão geral, a constitucionalidade da detração do recolhimento domiciliar noturno e nos dias de folga, considerando a relação entre a cautelar cumprida e o regime de pena aplicado. É um tema jurídico relevante e que merece ser acompanhado com responsabilidade, especialmente pelos possíveis reflexos em outros processos.
