*The path of least resistance to devolution* If there is any genuine interest in devolving powers & resources to local levels (which everyone seems to agree on publicly), there's a very simple route to do so which could both a) sidestep all the cumbersome political, logistical and administrative challenges associated with immediately establishing several new provinces, and b) make it harder for entrenched dynastic elites to resist without looking like obstacles to commonsense devolution. This pathway involves going beyond platitudes about 'empowered local governments' to concretely expanding protections and resources for said LGs in the constitution to permanently prevent their subversion by provincial elites. Here are some of the key constitutional changes that could achieve this (some of these changes were also proposed by Dr Sania Nishtar in 2023): 1. Amend Article 7 (Definition of "State") Explicitly add local governments (divisional or district) as a constitutional tier of the state, alongside federal and provincial governments. 2. Amend Article 32 (Local Government Principle) Change "encourage local government institutions" to "establish, protect, and sustain local governments" making LGs a mandatory constitutional entitlement rather than a vague policy directive. 3. Replace Article 140-A with a new Part (Local Governments) containing the following articles: i) Article 140A. Establishment of Local Governments - Designate Divisional or District Government (debatable, there's good arguments for both) as the primary LG unit. Call them administrative units if you want, though I think that's a restrictive definition. - Mandate LG elections within 60 days of passage and/or expiry of existing LGs. - Fix the term at 4-5 years, and outlaw provinces' ability to dissolve LGs. ii) Article 140B. Provincial Finance Commission (PFC) - Mandate an independent PFC in each province with opposition and LG representation. - Mandate a minimum % (60%?) share of the provincial divisible pool for LGs. - Base horizontal allocation on population, GDP growth, revenue effort, and demographic performance. - Make PFC decision implementation mandatory & time-bound. iii) Article 140C. Divisional or District Governments (again, could be either) - Constitute each administrative division or district as an elected Divisional/District Council, with its own Nazim-e-Ala - Reserve seats for women, farmers/workers, and minorities - Devolve exclusive authority over: spatial planning, primary/secondary education, primary healthcare, water/sanitation/waste, local roads/transport, agriculture/livestock services, sub-canal irrigation, SME promotion, local environment, culture/sports, and social welfare. - Devolve revenue powers: some property taxes, professional tax, entertainment taxes, vehicle fees, service charges, and others. iv) Article 140D. Prohibition on Parallel Structures and Override - Abolish MNAs/MPA discretionary powers over development funds within LG jurisdictions, limit their roles to consultation & route all development funds through LGs. - Remove executive authority of DCs over devolved subjects; limit DC role to administrative execution under elected reps. 4. Insert a new Sixth Schedule — Subjects Devolved to Local Governments Constitutionally enumerate the subjects listed in Article 140C above to prevent provinces from legislatively reclaiming them. This pathway doesn't rule out new provinces down the line wherever it's feasible but still effectively achieves the stated purposes of devolution in the meantime without incurring any of the costs or instability associated w/ new provinces. Does it limit provincial powers over LGs? Yes because provinces have proven they can't be trusted with it & need constitutional guardrails to prevent hoarding of power & resources.
