*پنجاب حکومت کی جانب سے آئین کے آرٹیکل 151 کی مسلسل خلاف ورزی کے بعد وفاقی حکومت کی آئین کے آرٹیکل 161(2) کی تین سال سے مسلسل خلاف ورزی* خیبرپختونخوا کے حقوق پر مسلسل قدغن، پنجاب کو اضافی وسائل کی فراہمی پر سوالات 1. پنجاب حکومت کی جانب سے آئین کے آرٹیکل 151 کی مسلسل خلاف ورزی کے باعث گندم کی بین الصوبائی ترسیل میں رکاوٹیں پیدا ہوئیں، جس کے نتیجے میں نہ صرف خیبرپختونخوا بلکہ ملک بھر میں گندم کی قیمتوں میں نمایاں اضافہ ہوا۔ وفاقی ادارہ شماریات کی جاری کردہ رپورٹ کے مطابق رواں سال ملک میں گندم کے نرخوں میں 85 فیصد تک اضافہ ریکارڈ کیا گیا ہے۔ 2. دوسری جانب وفاقی حکومت بھی گزشتہ تین سال سے آئین کے آرٹیکل 161(2) کی مسلسل خلاف ورزی کر رہی ہے اور خیبرپختونخوا کو اس کے آئینی حق، یعنی خالص پن بجلی منافع (Net Hydel Profit) کی مکمل ادائیگی نہیں کی جا رہی۔ آئین کا آرٹیکل 161(2) کیا کہتا ہے؟ آئینِ پاکستان کے آرٹیکل 161(2) کے تحت کسی صوبے میں واقع پن بجلی گھر سے حاصل ہونے والے خالص منافع کا حق اسی صوبے کو حاصل ہے جہاں وہ پن بجلی گھر واقع ہو۔ اس آئینی اصول کے تحت پن بجلی کی پیداوار کے ماحولیاتی، سماجی اور معاشی اثرات برداشت کرنے والے صوبے کو اس کا خالص پن بجلی منافع (NHP) ادا کیا جانا لازم ہے۔ 3. خیبرپختونخوا پاکستان کا سب سے بڑا پن بجلی پیدا کرنے والا صوبہ ہے اور قومی گرڈ میں مجموعی پن بجلی پیداوار کا 70 فیصد سے زائد حصہ فراہم کرتا ہے، جبکہ پنجاب کی پن بجلی پیداوار تقریباً 30 فیصد ہے، جس میں نمایاں حصہ غازی بروتھا پن بجلی منصوبے اور دیگر منصوبوں سے حاصل ہوتا ہے۔ اس تناظر میں خیبرپختونخوا کو صوبے میں ہونے والی پن بجلی کی پیداوار کی بنیاد پر خالص پن بجلی منافع میں ایک اہم آئینی حق حاصل ہے۔ 4. گزشتہ تین سال، یعنی 2024 سے 2026 کے دوران خالص پن بجلی منافع کی مد میں پنجاب کو 177.7 ارب روپے ادا کیے گئے، جبکہ خیبرپختونخوا کو صرف 71.5 ارب روپے ملے۔ یوں پنجاب کو خیبرپختونخوا کے مقابلے میں 106.2 ارب روپے زیادہ ادا کیے گئے، حالانکہ پن بجلی کی پیداوار کے اعتبار سے خیبرپختونخوا کا حصہ پنجاب کے مقابلے میں کہیں زیادہ ہے۔ 5. اسی عرصے کے دوران خیبرپختونخوا میں واقع 12 پن بجلی گھروں نے مجموعی طور پر 61.2 ارب یونٹس بجلی پیدا کی، جبکہ پنجاب میں واقع پن بجلی گھروں کی اسی مدت کے دوران مجموعی پیداوار صرف 23.5 ارب یونٹس رہی۔ 6. ان اعداد و شمار کے باوجود وفاقی حکومت کی جانب سے پنجاب کو 106.2 ارب روپے اضافی خالص پن بجلی منافع کی مد میں ادا کیے گئے، جبکہ خیبرپختونخوا کو اس کے جائز اور آئینی حق سے محروم رکھا گیا۔ یہ صورتحال وفاقی حکومت کی جانب سے وسائل کی تقسیم میں واضح عدم توازن اور پنجاب حکومت کے حق میں غیر معمولی جھکاؤ کی نشاندہی کرتی ہے۔ وزیراعظم شہباز شریف کی جانب سے پنجاب حکومت کو مضبوط اور کامیاب بنانے کے لیے اضافی وسائل فراہم کیے جانے کا تاثر اس وقت مزید گہرا ہوتا ہے جب خیبرپختونخوا کو اس کے آئینی اور جائز حقوق کی ادائیگی میں مسلسل تاخیر کا سامنا ہو۔ وفاقی وسائل کی غیر متوازن تقسیم سے خیبرپختونخوا کے عوام کے ساتھ ناانصافی کا احساس بڑھ رہا ہے اور ان کے معاشی حقوق متاثر ہو رہے ہیں۔ 7. خیبرپختونخوا حکومت کا دوٹوک مطالبہ ہے کہ صوبے کو اس کا جائز آئینی حق فوری طور پر دیا جائے اور خالص پن بجلی منافع کی مد میں واجب الادا 106.2 ارب روپے فوری جاری کیے جائیں۔ اس معاملے کو مزید تاخیر کے بغیر مشترکہ مفادات کونسل (CCI) کے اجلاس میں پیش کیا جائے تاکہ آئین کے مطابق وسائل کی منصفانہ تقسیم اور خیبرپختونخوا کے حقوق کا تحفظ یقینی بنایا جا سکے۔

چار پانچ دن پہلے مشیر خزانہ پختونخوا@MuzzammilAslam3 بھائی نے X پر میری توجہ بے نظیر انکم سپورٹ پروگرام کے 8 لاکھ 10 ہزار فیول چارجز کی طرف دلائی تھی اور میں نے بھی معاملے کو انوسٹی گیٹ کر کے بات کرنے کا وعدہ کیا تھا۔اس لئے تمام معلومات یہاں شیئر کر رہا ہوں ! بے نظیر انکم سپورٹ پروگرام BISP کے پاس 75 گاڑیاں ہیں( اسلام آباد8 2 سندھ 17 پنجاب 12 پختونخوا 7 بلوچستان 6 اور کشمیر 5) اس کے علاوہ 32 رجسٹریشن وین ہیں۔کل 107 گاڑیاں۔ تیل کا یہ خرچہ 2020 سے 2025 تک پانچ سال میں ہوا ھے ۔ گویا ایک مہینے میں 100 گاڑیوں کا خرچہ 10 ہزار لیٹر یا ایک گاڑی 100 لیٹر خرچہ ( میرے خیال میں مناسب ھے) نوٹ ! ان پانچ سالوں میں 2 سال پی ٹی آئی اور باقی 3 سال شہباز شریف کی حکومت رہی!
