فائدة من #الواقع_العملي: ⭕️سلسلة مهمة⭕️ إن كنت مشغولاً ففضلها وعد إليها لاحقاً.. الأسبوع الماضي تشرفت بلقاء أحد #القضاة السابقين بعد أن أمضى في المحاكم ما يربو على ٣٠ سنة، فطلبت منه نصيحة جامعةً في #الصياغة فأجابني: ١- لا تضمّن مذكرتك دفوعاً واهية: يقول: القضاة تمر عليهم عشرات المذكرات يومياً، وبمجرد اطلاعهم السريع على المذكرة يستشفون موقف صاحبها (قوةً أو ضعفاً) عن طريق تركيزه وتشتته. وهذا ما يسميه فقهاء القانون بـ (عقيدة المحكمة). ٢- لا تركن إلى فهمك للمذكرة؛ اكتبها للغير: الكثير من المذكرات كخط الطالب السيء ولكن باسلوبها، لا يستطيع قراءتها وفهمها إلا من كتبها، إن لم تستطع قراءتها بقبعة الغير فاعرضها على الغير واطلب منه فهمها وشرحها لك حتى تتأكد من وصول ما تريد إيصاله. ٣- وازن بين الاختصار والإطالة: بعض المذكرات تقرأها وكأنها متنٌ فقهي من تركيزها، كاتبها يعتقد أنه بذلك قد أجاد، وهو في الحقيقة واهم. والصحيح أن يتزن بين الاختصار والإبانة كي يُفهم مراده فهماً دقيقاً. ٤- مواد النظام: يفترض بعض الكتبة أن سرد مواد النظام وحشو المذكرة بها يجعلها أقوى، وعلى النقيض: يفترض البعض الآخر أن القارئ يحفظ جميع المواد، والتوازن يكمن في حسن تكييف الواقعة ومطابقتها للمادة المستشهد بها مع الاقتصار على موطن الاستدلال منها ومناسبته. ٥- لا تغش المحكمة، فهي تفهم جيداً: يقول: بعض المذكرات أشبه بألعاب التذاكي، يسوق الخصم دليلاً او مادةً مجتزأة أو غير منتجة ويعتقد بذلك أنه ينجح في تضبيب رؤية الدائرة، هذا التصرف -رغم عدم جدواه- يؤثر على (عقيدة المحكمة) في كل ما تكتب. ٦- ركز على طلباتك،فمنها المبتدى وإليها المنتهى: بعض المذكرات تكون رائعةً في صياغتها وحبكتها، ولكنها تختتم بطلباتٍ لا تتفق مع التكييف الصحيح؛ ولأنه لا يجوز للمحكمة الحكم بما لم يطلبه الخصوم فإن عدم إتقانها قد يتسبب في إهدار كل الجهد المبذول، وقد يتسبب في أحكام شكلية أو موضوعية كارثية. سأكمل لاحقاً .. فضلوها وشاركوها، وأعطونا وجهة نظركم 🙏🏻
