Hay una vida construida alrededor de las reglas y los documentos que el propio gobierno le fue dando. El TPS es temporal. Nadie discute eso. Pero su carácter temporal no justifica desmantelar de golpe la vida de quienes estuvieron amparados por él. Si Washington decide terminar esa protección, debe ofrecer una transición razonable: por lo menos un año para organizar una salida, evaluar alternativas legales y resolver obligaciones familiares y económicas. La inestabilidad venezolana tampoco desaparece porque una decisión administrativa dé por terminado un programa. Con el asilo pendiente, la contradicción es todavía más cruel. Una solicitud no equivale a un asilo concedido, y un permiso de trabajo no otorga por sí solo un estatus migratorio ni inmunidad frente a una detención. Entendido. Pero esa distinción jurídica no resuelve la pregunta política y moral: ¿qué responsabilidad tiene el Estado que autoriza a alguien a trabajar mientras mantiene su caso sin resolver durante años? Cuando la espera se alarga hasta una década, ya no estamos hablando de una maleta a medio hacer. Estamos hablando de carreras, negocios, hipotecas e hijos que han crecido aquí. El arraigo no concede automáticamente la residencia, pero debería pesar en la manera de aplicar la ley. Quien ha cumplido con las exigencias de su proceso merece una decisión oportuna, debido proceso y un trato digno. La incapacidad administrativa del gobierno no debería convertirse en una condena adicional para quien lleva años esperando su respuesta. Por eso considero inhumana esta forma de proceder. Una política que exhibe detenciones como trofeos electorales corre el riesgo de sustituir la solución del problema por la inflación de sus estadísticas. Estados Unidos necesita una política migratoria funcional, estable y práctica, con reglas claras y una burocracia capaz de resolver los casos. Defender la migración legal exige hacer que esa vía funcione. El Estado no puede tardar diez años en contestar y después exigir que una vida se desarme en diez minutos.
