Abolition de la peine de mort : 45 ans d’une norme devenue constitutionnelle Le saviez-vous ? C’est l’ancien président du Conseil constitutionnel Robert Badinter, qui est à l’origine de l’abolition de la peine de mort. Il est alors garde des Sceaux lorsque François Mitterand lui confie la mission de porter ce projet devant l’assemblée nationale. 🗳️ Son projet de loi est adopté par le Parlement et promulgué le 9 octobre 1981, il y a 45 ans, faisant de la France le 35e État à abolir la peine de mort dans le monde. Mais l’histoire ne s’arrête pas là… Elle est d’ailleurs intimement liée à la Constitution et au Conseil constitutionnel. Une idée ? ✅ En 1985, saisi par le Président de la République pour étudier un traité international, le Conseil constitutionnel confirme que l’abolition de la peine de mort est conforme à la Constitution française. 📜 En 2007, le Parlement se réunit en Congrès et vote une révision constitutionnelle qui introduit l’article 66-1 dans la Constitution de 1958. Ce nouvel article garantit que « Nul ne peut être condamné à la peine de mort ». Dès lors, l’interdiction de la peine de mort n’est plus seulement une loi : elle devient une norme constitutionnelle, placée au sommet de notre ordre juridique, et dont le Conseil constitutionnel est le gardien. Ce changement de statut rend plus difficile un éventuel rétablissement de la peine de mort, puisque cela impliquerait une nouvelle modification de la Constitution. 👉Une évolution qui dépasse les clivages politiques, et qui illustre la manière dont notre Constitution évolue avec son temps, afin de protéger les valeurs et les transformations majeures de notre société.
