Ek 16'ncı madde kanuna 2018 yılında girmişti. Bu madde yoluyla bugüne kadar orman sınıraları dışına çıkarılan orman alanı miktarı 5 bin hektarın biraz üzerindeydi. Bu kararla bir seferde en yüksek miktarda orman alanı orman sınırları dışına çıkarılmış oldu. Bugünkü kararla orman sınırları dışına çıkarılan alanların 3 bin 882 hektarı Ankara Kızılcahamam'da. Ek 16'ncı madde orman sınırları dışına çıkarılan alanın en az iki katı hazine arazisinin OGM'ye verilmesini ve bu arazilerin orman yapılmasını öngörüyor. Buna karşılık ilgili kararlarda nerelerin OGM'ye verildiğine dair bir bilgi bulunmadığı gibi OGM'den de bu konuya ilişkin kamuyu bilgilendiren bir açıklama yapılmıyor. Fakat OGM tarafından açıklanan ağaçlandırma istatistikkerine bakıldığında, 2021-2025 yılları arasındaki beş yılda yapılan toplam orman dışı ağaçlandırma miktarı 3 bin 192 hektar.
